Terms of Use

These terms are an agreement between you and Nicholas Webster ("we", "us"), the operator of Warmly. By using Warmly you agree to them. If you do not agree, do not use the app.
1. What Warmly is
Warmly lets you leave a short anonymous message at a physical place. After a delay, that message becomes available to one other person who later visits that place. They see it once. They may respond with a like, which sends you a notification. There are no names, profiles, threads or replies.
2. You must be 18 or over
Warmly is for adults only. By using the app you confirm you are at least 18 years old. If we become aware that a user is under 18, we will terminate their access.
3. Your account
Warmly has no accounts, usernames or passwords. Your device identifies itself to our servers using an anonymous cryptographic key held on the device. We do not know who you are.
This means:
- You cannot log in from another device.
- If you delete the app, uninstall it, or reset the device, you lose access to anything associated with it. There is no recovery process.
- Messages you have already left will continue to be delivered.
4. Rules for what you send
You must not send anything that:
- Is hateful, harassing, threatening, abusive or discriminatory
- Is sexual, obscene or otherwise inappropriate
- Promotes violence, self-harm, or illegal activity
- Identifies, targets or refers to a specific person
- Contains advertising, promotion, spam or links
- Contains personal information about you or anyone else, including contact details
- Infringes anyone's rights, including copyright
- Is intended to distress, mislead or manipulate whoever receives it
Every message is checked automatically before it is made available to anyone else. We may reject a message without explanation.
Messages are limited in length and to a restricted set of characters. The app is English-language only.
5. Reporting and enforcement
Every message you receive can be reported from within the app. We review reports and will act on them within 24 hours. Where a message breaches these terms, we may delete it, remove other messages left by the same sender, and block that sender from using Warmly.
We may suspend or terminate access at any time, without notice, where we consider these terms have been broken.
There is no appeal process. Because Warmly is anonymous, we have no way to verify who is asking.
6. Content you leave
You keep any rights you have in what you write. By leaving a message you grant us a worldwide, royalty-free licence to store it, check it, transmit it to a recipient, and quote a short part of it back to you in a notification, for as long as needed to operate the service.
You confirm the message is yours to send and does not breach section 4.
7. Content you receive
Messages come from strangers. We check them, but automated checks are not perfect and something objectionable may reach you. If it does, report it.
You must not attempt to identify the sender of a message, or use Warmly to find, follow or contact any individual.
Do not rely on Warmly for anything important. It is not a messaging service, a way to reach a specific person, or a way to communicate in an emergency.
8. Location and safety
Warmly requires access to your location at all times in order to work. You choose where to leave messages and where to go.
Use common sense about where you go and when. Never travel somewhere unsafe, trespass, or put yourself at risk in order to leave or collect a message. Warmly gives no indication of whether a place is safe, public, accessible or lawful to enter. You are responsible for your own safety.Do not use the app while driving, cycling, or doing anything else that needs your attention.
9. Availability
Warmly is provided as-is. We do not promise it will be available, that messages will be delivered, that any message will reach anyone, or that you will ever receive one. Delivery depends on someone else physically visiting the place you chose, which may never happen.
We may change, suspend or withdraw the service, or any part of it, at any time.
10. Messages are not stored for you
Warmly is not a store of your writing. A message you receive is shown once and is then gone. Messages you have left are deleted after they are delivered. Keep your own copy of anything you want to keep.
11. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, we are not liable for any loss or damage arising from your use of Warmly, including from anything a stranger sends you, anything that fails to be delivered, or anything that happens to you at a place you travelled to.
Warmly is provided for personal, non-commercial use. We are not liable for business losses.
12. Changes to these terms
We may update these terms. The current version is always available here. Continuing to use Warmly after a change means you accept it.
13. Governing law
These terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your local law.
